Every person who is arrested in England and Wales and taken to a police station to be interviewed by the police is entitled to free legal advice and representation at the police station.

Magistrates Court
If you are charged with a criminal offence and taken to Court, an application for legal aid will be completed and sent to the Magistrates/Crown Court for assessment. The court, when assessing your application for legal aid, will determine whether or not it is in the interests of justice for representation to be granted. In addition, assessment will also be made on whether or not you are financially eligible.
Crown Court
If your case goes to the Crown Court for trial, you will automatically qualify for legally aided representation once you have completed an application form. After you have been means tested, you may have to pay towards the cost of your defence. This could be from your income while the case is ongoing and/or from your capital, if you are convicted.
